PREAMBLE
This document is subject to change without notice.

A “User” is anyone who connects with dreamworld in any way, and/or who receives any or all of dreamworld’s services.

The dreamworld Network is a high-speed non-profit, non-commercial network, which makes computer and network facilities available to dreamworld users for non-commercial and altruistic purposes. The dreamworld network interconnects with many other networks (Networks), including those operated by various Internet Service Providers, other dreamworld users, governmental agencies of the United States and/or other countries, and entities sponsored by such agencies.

ACCEPTABLE USE
This dreamworld acceptable use policy (AUP) was created to meet dreamworld’s goals and strategies relating to information systems security, and to maintain dreamworld’s reputation in the industry as a responsible network provider. dreamworld believes in preserving the value of the Internet as a secure and reliable communication tool for the free expression of ideas and the unhindered flow of information by and between individuals everywhere.

The AUP ensures dreamworld’s compliance with commonly accepted operating practices and was designed to provide for the security, reliability, and privacy of dreamworld’s systems and networks, and the networks and systems of others. Additionally, the AUP is designed to encourage the responsible use of the network, and to avoid situations which may cause dreamworld to incur civil liability. The dreamworld AUP is updated periodically. Changes take effect when posted on the dreamworld Network Web Page at http://www.dreamworld.org/tos . Failure of the User to conform to this AUP will have significant impact on dreamworld, and on the integrity, confidentiality, and availability of the dreamworld Network and its components to other dreamworld Users. All violations of the dreamworld AUP will be reviewed for appropriate action, including termination or limitation of access.

User agrees that :

1.May only use the dreamworld Network for lawful purposes.

2.Must at all times comply with the local, state, and federal laws of the United States, its territories, and possessions, and with the laws of any countries through which data is transited using the dreamworld  Network.. 

3.Must at all times comply with the then-current dreamworld AUP.

4.Must at all times comply with the AUP of other Networks that they traverse.

5.Are responsible for keeping accurate and timely User contact information with dreamworld and for notifying dreamworld of any changes in such information.

6.May not use the dreamworld Network to transmit information in violation of any United States or state regulation, including but not limited to, copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret.

7.May not allow any minor child to access the dreamworld Network or other Networks without the express written permission of the parent or guardian of such minor.

8.May not use the dreamworld Network for illegal or improper activities of any kind, or for any activities which give rise to civil liability.

9.May not attempt unauthorized use of dreamworld machines or other machines on the Internet.

10.May not utilize any program, utility, file, or script in the attempt to probe or gain access to the machines of others.

11.May not attempt to circumvent user authentication or the security of any machine.

12.May not forge header or user identification information on emails or Usenet postings.

13.May not use the dreamworld Network to harass others, whether through language, frequency, or size of messages.

14.May not use the dreamworld Network for software piracy.

15.May not use the dreamworld Network for the creation or forwarding of chain letters, pyramid schemes, or any other activity which if conducted by Unites States Mail would be in violation of the United States Postal Regulations.

16.May not utilize any Internet Relay Chat (IRC) program, utility, file, or script to interfere with or deny service to other users on any machine.

17.May not transmit or post any information, which contains illicit code, viruses, trojan horses, worms, or other harmful components designed to violate security, interfere with the proper operation of any computer system, or to destroy data.

18.May not transmit any commercial (i.e. profit-motivated) mail messages or usenet postings, or store any commercial content in any dreamworld FTP or WWW account, or use any dreamworld service to promote or engange in any commercial activity, including
but not limited to the displaying of graphic or text advertisements.

19.May not post commercial messages to Usenet newsgroups.

20.May not post binary files to newsgroups whose charters do not allow such postings.

21.May not post the same or similar messages which are directed to either inappropriate, unrelated, or more than 5 Usenet newsgroups.

22.May not attempt to interfere with, or deny service, to any user or host.

23.May not operate an open Simple Mail Transfer Protocol (SMTP) relay that forwards traffic from any third parties which may connect to it.  

24.May not engage in any unreasonable activity, which causes multiple complaints by third parties.  

25.May not engage in any activity, which directly or indirectly causes degradation in the performance of the dreamworld Network.

26.May not allow any third party to directly or indirectly use any component of the dreamworld Network in a method that would constitute a violation of the dreamworld AUP if such use were made directly by the User.

27.May not engage in any of the foregoing activities using the service of another provider, but channeling such activities through the dreamworld Network.

28. In order to let users know there are routes of appeal, User will provide a link on the main web page that hyperlinks to the dreamworld.org main web site. http://www.dreamworld.org.  Optionally, User may display the "Return to dreamworld" graphic at http://www.dreamworld.org/commonpics/returntomain.gif

29. Privacy guidelines:  Must not use cookies, referrers, javascript, or any scheme whatsoever for the purpose of extracting information from domain visitors.  Such information may only be *requested*, after giving the domain visitor full disclosure regarding what information is being requested, what the information will be used for, and the promise to keep that information secret, meaning known only to the User.  Dreamworld does not permit its Users to share any domain visitor information with any third parties unless under a valid court order.  In addition, User must not embed web code linked to external domains when the result of that web code would be to violate this section.

 

ADDITIONAL RULES FOR THE USE OF  COMPUTER AND DIALUP FACILITIES
dreamworld Account Usage: An individual Personal Shell, or FTP, POP3, or Telnet Account entitles only the named user to login, and on only one dialup modem, TCP/IP or pseudo-terminal session at a time. Family or Organization Shell Accounts allow multiple individuals within an organization to access dreamworld, but only one at a time (consecutively), and only on one login session. Other uses are considered fraudulent.

Process Rules: The use of "bots" or any process accepting TCP/IP connection requests is prohibited. Users are allowed to run one process at a time, only while logged in, and provided the job does not have an adverse effect on system availability or response time. This single process rule does not apply to up to 3 stopped jobs in the background, or child processes made available by dreamworld for use by its Users. With the exception of the "TIA" program, the use of TCP/IP software emulators such as the "SLIRP" program are prohibited on dreamworld shell hosts.

Modem Usage: Shell and telnet accounts include unlimited access to our network of servers.  We ask that when you plan to be idle for more than a few minutes you hang-up or disconnect your session, and then reconnect when you are ready to continue. This helps insure that our dialup modems and daemons are available for all users to share. dreamworld reserves the right to periodically reset modems or end TCP/IP sessions, and such activity does not constitute a degradation or denial of dreamworld service.

Disk Storage: Storage of user data must be done within the user’s assigned home directory, or as assigned by dreamworld staff. Usage of other disk space is prohibited, except by dreamworld system programs making temporary use of the system’s public filesystem areas. Users desiring more than the assigned amount of storage should contact dreamworld to make special accommodations.

Mail Usage: Commercial bulk mailing from dreamworld is not permitted. Users sending letters with more than 5 recipients must run consecutive mail delivery programs.

USENET Usage: Groups in the dreamworld.* hierarchy are not intended to advertise goods or services offered by other service providers. The cross posting of articles into non-related newsgroups is strongly discouraged due to the congestion created by this practice. dreamworld recommends that new users read Virginia Shea’s "Netiquette" before posting articles to the network.

13.dreamworld reserves the right to cancel at any time any account without cause and without notice.

14.dreamworld reserves the right to suspend any account for violation of the dreamworld AUP.  Dreamworld reserves the unilateral right to terminate service for any reason whatsoever, or for no reason.  Dreamworld does not guarantee the presence, quality, or reliability of any service.

15.In the event that a violation of the dreamworld AUP requires a dreamworld technician to administrate and/or correct, the violator may be billed for the actual technician time at the then-prevailing dreamworld rate.

SEVERABILITY
If any portion is held to be invalid by a court of law, such a ruling shall not affect any other part of this agreement, which shall be considered to be in full force and effect.

LIMITATION OF LIABILITY
dreamworld exercises no control whatsoever over the content of the information passing through dreamworld. Dreamworld does not and cannot monitor activity occurring within its domain.  dreamworld makes no warranties of any kind, whether expressed or implied, as to the availability, accuracy, or content of the information, products, or services it is providing.  dreamworld also disclaims any warranty of merchantability or fitness for a particular purpose.  dreamworld will not be responsible for any damages suffered by any User.  This includes loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by its own negligence or User’s errors or omissions.  Use of any information obtained via dreamworld is at User’s own risk.  dreamworld specifically denies any responsibility for the accuracy or quality of information obtained through its services.

Any liability of dreamworld, including without limitation any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay, in operation or transmission, communications line failure, theft or destruction of or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action, shall be strictly limited to the non-penalty amount paid by or on behalf of the User to dreamworld for the current month.

Your use and browsing of the Site is at your risk. Neither Site Owner nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site. Without limiting the foregoing, everything on the Site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties. Site Owner also assumes no responsibility, and cannot be liable for any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site, or your downloading of any materials, data, text, images, video, or audio from the Site.

Availability of Product. Since the Site may be accessed from sources internationally where Site Owner does not do business, Site Owner does not represent that it is doing business in all such areas, or that its products or services will be available in any particular country or jurisdiction.

User agrees to indemnify, defend, and hold harmless dreamworld, as well as any and all dreamworld staff and/or upstream providers, from any and all claims resulting from User’s use of the service, which damages User or any other party.

In the event of any legal action, User agrees to pay for any and all costs related to any litigation, including but not limited to court costs, travel costs, attorney's fees,  fines imposed by the court, restitution costs, whether incurred by themselves or by dreamworld, any dreamworld staff, or dreamworld's upstream ISP.

By connecting in any way whatsoever to any dreamworld server, User legally affirms that User will abide by all the terms in this agreement at all times.

These Terms and Conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Any use of any kind by anyone of dreamworld services constitutes acceptance of these Terms and Conditions.
